Judge Jackson used some blunt, harsh language in referring to Microsoft
in his Memorandum and Order today. The document is short; probably
about 3 - 4 typed pages; it is pretty much devoid of "legalese"; it
might make interesting reading. A copy is on the DOJ site in HTML, at:
http://www.usdoj.gov/atr/cases/f4900/4910.htm
A few days ago, Microsoft asked for more hearings with Judge Jackson, as
to whether, and how, the company should be disciplined/ broken up/
whatever. Today, in rejecting further hearings, quoting Judge Jackson:
"Second, there is credible evidence in the record to suggest that
Microsoft, convinced of its innocence, continues to do business as it
has in the past, and may yet do to other markets what it has already
done in the PC operating system and browser markets....
"Third, Microsoft has proved untrustworthy in the past. In earlier
proceedings in which a preliminary injunction was entered, Microsoft's
purported compliance with that injunction while it was on appeal was
illusory and its explanation disingenuous..."
Judge Jackson's longer Final Judgment is the document in which he orders
the company's divestiture/ split-up, and other steps. It is quite
lengthier, contains some fairly technical provisions (both legal, and as
to tech matters), but might also be interesting reading. It is also on
the DOJ site at:
